In such cases, the processing of that Personal Data is governed by the terms of a specific Data Processing Addendum (DPA) or similar agreement with our client, and the client's privacy policy will apply to that data. This Policy primarily addresses our activities as a Data Controller.

A. Information You Provide Directly to Us:

As noted earlier, when we process such data on behalf of our clients, we act as a Data Processor, and this processing is governed by our agreement with the client.

D. Sensitive Personal Data:

Temporal Consulting does not intentionally collect or solicit "Sensitive Personal Data" (such as information about race or ethnicity, political opinions, religious or philosophical beliefs, trade union membership, health data, genetic or biometric data, or sexual orientation) through our public Site. We request that you do not provide such information to us through general Site contact forms or emails.

If the provision of our services to a client (e.g., "mortgage loan modernization") requires the processing of data that may be considered sensitive or falls into special categories under applicable law, such processing will be strictly governed by the terms of our agreement with that client (including a DPA) and subject to appropriate security measures and legal safeguards. In such scenarios, Temporal Consulting will be acting as a Data Processor based on the client's instructions.

III. How We Use Your Information

When Temporal Consulting processes Personal Data provided by a financial client for a specific project (e.g., customer mortgage data, trading analytics data), the use of that data is strictly limited to the purposes defined in the client agreement (MSA/DPA). Such client-provided data is not used for Temporal Consulting's own marketing, business development, or any other unrelated business purposes.

IV. Legal Basis for Processing Your Information

We process your Personal Data only when we have a valid legal basis to do so under applicable data protection laws. The legal bases we typically rely on include:

  • Consent: We may process your Personal Data if you have given us your explicit consent for one or more specific purposes. For example, we may rely on consent for sending certain marketing communications or for placing non-essential cookies on your device. You have the right to withdraw your consent at any time.
  • Contractual Necessity: We may process your Personal Data when it is necessary for the performance of a contract to which you are a party, or to take steps at your request before entering into such a contract. We implement contractual safeguards, such as Data Processing Addenda (DPAs) incorporating Standard Contractual Clauses where applicable, with our contractors to ensure that Personal Data is protected and processed in accordance with applicable data protection laws and our instructions. Transparency with our financial clients regarding the use of international contractors and the safeguards in place is a priority for maintaining trust and complying with their vendor management requirements.
  • Clients: We may share information with our clients as necessary for the provision of our services. This may include project progress reports, details of team members assigned to their project (with appropriate controls), and other communications relevant to the engagement. Personal Data processed by us on behalf of a client (as a Data Processor) is shared and disclosed strictly in accordance with the terms of our agreement with that client.
  • Legal and Regulatory Requirements: We may disclose your Personal Data if we are required to do so by law, subpoena, court order, or other legal process, or if we have a good faith belief that such disclosure is reasonably necessary to:
  • Comply with a legal obligation.
  • Protect and defend the rights or property of Temporal Consulting.

The complex web of data flows involving our US-based LLC, international contractors, and potentially international clients necessitates a robust approach to international data transfers. Financial clients, in particular, may have stringent requirements regarding data localization or cross-border transfers, and we are prepared to discuss and implement appropriate measures to meet these requirements and ensure compliance.

By using our Site or providing us with your Personal Data, you acknowledge that your Personal Data may be transferred to and processed in countries outside of your country of residence, including the United States.

Temporal Consulting takes the security of your Personal Data seriously. Security for Client Project Data:

For Personal Data processed by Temporal Consulting on behalf of our clients (particularly sensitive data within the financial sector, such as in "mortgage loan modernization" or "SWIFT replacement" projects), specific and often more stringent security measures will be implemented. These measures are detailed in our client agreements (including MSAs and DPAs) and are designed to align with industry best practices, client-specific requirements, and applicable regulatory standards. The security of our public Site (Temporalconsulting.ai) and general business data is managed robustly, but the protocols for client project environments are typically subject to heightened controls and client oversight. Our international contractors who may access client data are contractually bound to adhere to these security standards.

VIII. Data Retention

Temporal Consulting will retain your Personal Data only for as long as it is necessary to fulfill the purposes for which it was collected, as outlined in this Policy, or for as long as required to satisfy any legal, accounting, regulatory, or reporting requirements, or to resolve disputes.

The criteria used to determine our retention periods include:

  • The purposes for which we process the Personal Data and whether we can achieve those purposes through other means.
  • The length of time we have an ongoing relationship with you (e.g., as a client, contractor, or active Site user).

For example, we may retain a limited scope of Personal Data to prove compliance with applicable laws even after the primary purpose has been fulfilled.

  • Marketing contact information will be retained until you opt-out or withdraw consent, or for a defined period of inactivity (e.g., 5 years as per some industry practices), after which it may be deleted or anonymized.

For Personal Data processed by Temporal Consulting on behalf of our clients (as a Data Processor), the retention of such data will be governed by the terms of our agreement with the client, who, as the Data Controller, determines the applicable retention policies.

Upon expiration of the applicable retention period, we will securely delete or anonymize your Personal Data in accordance with applicable laws and our internal policies.

IX. Your Privacy Rights

Depending on your jurisdiction of residence and applicable data protection laws (such as the GDPR in Europe, CCPA in California, etc.), you may have certain rights regarding your Personal Data. Temporal Consulting is committed to respecting these rights. These may include:
